Overview
The Expert, Group Tax is responsible for establishing and overseeing the Group's tax governance framework, ensuring compliance with applicable tax laws and regulations, mitigating tax risks, and optimizing tax efficiency across the Group.
The position provides tax advisory support for investment activities, project development, mergers and acquisitions (M&A), and business transactions, while coordinating with tax authorities, external auditors, and internal stakeholders to address tax-related matters. In addition, the role analyzes the tax implications on financial performance, recommends appropriate tax strategies, and strengthens the Group's overall tax governance capabilities.
Responsibility
1. Group Tax Compliance Management
- Oversee the filing and payment of all applicable taxes, including Corporate Income Tax (CIT), Value Added Tax (VAT), Personal Income Tax (PIT), Foreign Contractor Tax (FCT), license fees, and land-related taxes.
- Ensure compliance with tax regulations throughout the entire real estate project lifecycle.
- Review tax returns prepared by subsidaries before submission to the tax authorities.
- Ensure consistency between accounting records, financial statements, and tax filings.
2. Real Estate Project Tax Management
- Monitor tax obligations throughout each stage of the project lifecycle, including investment preparation – construction – sales – project handover.
- Review tax-deductible expenses for Corporate Income Tax purposes on a project basis.
- Monitor interest deductibility, project cost allocation, and non-deductible expenses.
- Ensure invoices are issued in accordance with collection schedules and project handover milestones.
3. Land Tax & Project Financial Obligations
- Monitor statutory financial obligations, including land use fees, land rental, and taxes arising from land-use conversion.
- Coordinate with the Legal to monitor land legal documentation, adjust financial obligations resulting from planning changes, and ensure appropriate timing for recognizing land costs as project costs.
4. Transaction and Real Estate M&A Tax Management
- Advise on tax structures for: Project transfers/ Transfers of project holding companies / Investment cooperation (BCCs and Joint Ventures)
- Analyze the advantages and disadvantages of Asset Deals versus Share Deals.
- Calculate Corporate Income Tax, VAT (where applicable), registration fees, and other related tax obligations.
- Coordinate with tax advisors and auditors on major transactions.
5. Tax Cost Management & Tax Optimization
- Monitor tax-deductible expenses, including: Marketing and selling expenses/ Interest expenses (within statutory limits)/ Group overhead allocation
- Evaluate tax efficiency for each project by analyzing: After-tax profit margins /Tax impacts on project cash flows
- Recommend tax optimization solutions, including: Project company structures/ Cost allocation mechanisms/ Internal related-party transaction policies
6. Tax Risk Management & Internal Control
- Develop and maintain the Group's internal tax governance framework.
- Identify tax risks arising from: Real estate sales contracts/ Construction contracts/ Investment cooperation agreements
- Monitor common tax risks such as: Incorrect invoice issuance timing/ Revenue recognition errors/ Non-deductible expenses/ Improper project cost allocation
- Establish multi-level tax approval procedures.
7. Tax Audit & Inspection
- Represent the Group in working with tax authorities.
- Prepare supporting documentation, including: Project documentation/ Sales contracts / Expense documentation/ Cost of sales documentation
- Handle tax reassessments, late payment penalties, and adjustments to revenue and expenses.
- Coordinate with auditors and legal advisors during tax inspections.
8. Reporting & Management Analysis
- Prepare periodic reports on the Group's tax obligations, potential tax risks, and tax audit status.
- Analyze the impact of taxation on project profitability and tax efficiency across different project types.
- Recommend long-term tax strategies for the Group.
